A MUTARE regional court had to briefly adjourn on Wednesday morning after an attempted murderer case suspect soiled himself before being sentenced.
Ernest Gwayakwaya (22) of Mushati Village under Chief Zimunya, was convicted, and sentenced to five years imprisonment by regional magistrate, Mrs Phathekhile Msipa.
Gwayakwaya soiled himself before being cross-examined by regional prosecutor, Mr Last Goredema.
However, this did not save him as the court found him guilty and made him a guest of the Zimbabwe Prisons and Correctional Services for the next five years.
Prosecuting, Mr Goredema, said the complainant in this case was Sino Africa Mine that was being represented by Mr Nyasha Chinake.
He is employed by the company as an interpreter.
Mr Goredema said on April 12, at around 6pm, Sino Africa Mine security guard, Mr Clifford Mutya commenced duty at the mine in the company of another guard, Mr Prosper Tavengwa.
He was armed with a 303 rifle, loaded with two rounds.
Mr Goredema said during the night, the two guards carried out some patrols along the mine perimeter fence where they discovered a shaft dug by illegal miners.
They did not see any illegal miner at the shaft.
The next day, at around 6am, the two guards further patrolled around the mine, checking for any illegal activities.
They saw Gwayakwaya and five unknown accomplices in the shaft.
Mr Goredema said there were several bags loaded with gold ore which were ready to be carried out of the mine.
Mr Goredema also said the two security guards ordered Gwayakwaya and his accomplices to leave the mine, but they became violent and charged towards the security guards, armed with machetes, shovels and iron bars.
