A 29-year-old Bulawayo man yesterday appeared in court facing charges of sodomising his 22- year-old brother.
The man from Nkulumane 5 appeared before Western Commonage magistrate Abednico Ndebele facing a charge of indecently assaulting his brother.
The accused however told the court that his brother making up the allegations from spite after he caused his arrest and imprisonment for assault.
“My brother is making this up. He is just trying to fix me for sending him to prison when he assaulted me and my friend,” he said.
The complainant told the court that his brother was gay and it was no secret.
“My brother is gay everyone knows that. He abused me earlier this year. I had to report him because I’ve had enough,” he said.
The case was remanded to December 16, 2015 for trial at the Bulawayo regional court.
Prosecuting, Mufaro Mageza told the court that on an unknown date in April 2015 and during the night accused arrived home and found complainant allready asleep. “Accused person then forced the complainant to have anal sexual intercourse with him,” said Mageza.
The prosecutor said the matter was reported to the police leading to accused’s arrest.
