A 58-year-old Victoria Falls man has been sentenced to an effective 10 months in prison after assaulting a man he suspected of having an affair with his wife.
Khawulani Nyathi was convicted of assault by Victoria Falls magistrate Mr Tinashe Bushu after he struck Austin Ncube three times on the head with an axe handle.
Prosecuting, Ms Portia Mukanganya told the court that the incident occurred on April 2, 2026, at around 8pm at Jabula Tuck Shop in Victoria Falls.
She said Ncube was drinking beer with friends when Nyathi emerged from the darkness and attacked him.
“On 2 April 2026 at around 8pm, the complainant was drinking beer at Jabula Tuck Shop in the company of his friends. The accused person emerged from the darkness and struck the complainant three times with an axe handle on the head,” said Ms Mukanganya.
She told the court that Ncube managed to disarm Nyathi and seize the axe handle before the accused fled from the scene.
“The complainant managed to disarm the accused person of the axe and the accused person then went away. The complainant reported the matter to the police, leading to the arrest of the accused person.
“The complainant is still admitted at hospital and a medical report is yet to be produced. The accused person acted unlawfully,” said Ms Mukanganya.
Nyathi was found guilty and sentenced to 17 months’ imprisonment, with seven months suspended on condition of good behaviour.
The complainant remains admitted to hospital receiving treatment for injuries sustained during the assault.
