The 42-year-old commuter omnibus driver, who allegedly turned right into the lane of an oncoming fuel tanker and caused a fatal accident along the Harare-Bulawayo Road at Kuwadzana turn-off in October last year, has been jailed for three years after being convicted of culpable homicide.
The tragedy claimed eight lives and left scores injured.
Wellington Ngona was sentenced to an effective three years imprisonment by the Mbare Magistrates’ Court for culpable homicide.
He was banned from ever driving commuter omnibuses and heavy vehicles, while a six-month suspension from driving any other motor vehicle was imposed.
Allegations were that on October 31, 2024, at around 5:30am at the intersection of the Harare-Bulawayo Road and First Street, Ngona, who was driving a Toyota Hiace with 13 passengers, attempted to make a right turn into Bulawayo Road when his vehicle was hit by a haulage tanker travelling straight through the intersection.
The impact caused the commuter omnibus to overturn, leading to the fatalities and injuries.
Five victims died upon arrival at Sally Mugabe Hospital, while three more succumbed later at Parirenyatwa Hospital.
Investigations revealed that Ngona was negligent on the following particulars: failure to keep a proper lookout; and failure to take reasonable action to avoid a collision.
The National Prosecuting Authority of Zimbabwe has since urged public transport drivers to prioritise safety over speed and profit.
Last year, Transport and Infrastructural Development Minister Felix Mhona described the driver’s action as a “reckless” and a “blatant violation” of road rules.
He reminded and warned all transport operators, motorists and members of the public that the Ministry will take stern measures to preserve the safety and security of the commuting public.
