LATEST: Tomana’s application thrown out

Prosecutor General Johannes Tomana’s bid to appear before a retired or foreign judge in his dispute with the Judicial Service Commission has hit a snag.

Mr Tomana is seeking to block JSC from instituting proceeding for his removal from office.

While the challenge was pending, Mr Tomana sought referral of the matter to the Constitutional Court raising various points, chief among them the constitutionality of him appearing before a sitting judge of the High Court.

Justice Lavender Makoni today threw out Mr Tomana’s application for referral of the matter to the Constitutional Court.

This means his urgent chamber application to stop JSC from suspending him or embarking on the process leading to his possible removal from office will now be heard by Justice Makoni. – MORE TO FOLLOW
