Magaya remanded in custody to November 18

Harare regional magistrate Mrs Marewanazvo Gofa has thrown out Prophet Walter Magaya and his wife Tendai Magaya’s application for immediate release, ruling that their over detention has no bearing on their release.

Magaya was remanded in custody to November 18.

Mrs Gofa advised the couple to seek recourse as provided by the law, which includes approaching the Constitutional Court for compensation and damages.

The defence has since asked the court for the typed ruling to “prepare necessary review papers”.

Magaya, through his lawyers Mr Admire Rubaya and Mr Everson Chatambudza, told the court that he will not apply for bail at the Magistrate’s Court in respect of the fraud and rape cases, but will do so at the High Court.

Mrs Gofa said she has no jurisdiction to hear the bail submissions as it is a third schedule offense.

Tendai’s bail application is currently underway.
