(41) pleaded not guilty to theft charges when he appeared before magistrate Ms Patience Madondo who convicted him after a full trial.
He was slapped with five years in jail, but one year was suspended on condition of good behaviour.
Another year was set aside on condition he restitutes the complainant US$14 563, 00 on or before December 31 this year.
In aggravation, the State submitted that Nyore had committed a serious offence that was premeditated.
Prosecutor Catherine Manjengwa had urged the court to impose a custodial sentence on Nyore to meet the justice of the offence since nothing was recovered.
The State proved that on July 10 2011 a truck driver with U-Link Company parked his truck, which was loaded with 38 0000 litres of diesel at the company, premises.
Nyore hatched a plan to steal diesel from the truck.
He drove to an unknown destination where he offloaded 12 399 litres of diesel and came back to park the vehicle at the company premises the same night.
The following day Solomon Chinyenye came and drove off the vehicle destined for Zambia without realising that the vehicle had been tampered with.
The offence was discovered in Zambia after a shortfall of 12 399 of diesel had been discovered.
The matter was reported to the police and investigations led to Nyore’s arrest.
