A BULAWAYO businessman has filed a $10,000 lawsuit against his neighbour for adultery after he allegedly bedded his wife.
Naison Haruzivishe, who operates a printing company in Bulawayo, is accusing his neighbour, Maxen Matayo, a marketing officer at Nyaradzo Funeral Assurance Company, of sleeping with his wife, Vimbayi Dengeza. Dengeza and Matayo are workmates at the funeral services firm.
Haruzivishe, through his lawyer, Tungamirai Nyengera, is accusing Matayo of destroying his marriage by committing adultery with his customary law wife.
“On diverse occasions in and around Bulawayo, Matayo illicitly associated with and engaged in intimate relations with my wife, Vimbayi Dengeza, well aware of her marital status,” said Nyengera.
Haruzivishe said he tried to plead with Matayo several times to stop the alleged affair.
He also accuses his neighbour of enticing his wife to leave their matrimonial home in Romney Park.
“Consequently, this has seriously hurt and impaired Haruzivishe’s dignity. He has also lost companionship, love, care and conjugal rights from his wife because of the adulterous relationship,” said the lawyer.
Haruzivishe is demanding a total of $10,000 from Matayo for “contumelia damages suffered in respect of Matayo’s unlawful, malicious and illicit association” with his wife and “loss of consortium by reason of the withdrawal of the comfort, society, love, companionship and assistance by his spouse”.
Matayo has up to October 20 to enter an appearance to defend the matter at the Bulawayo Civil Court.
