A Harare woman claimed an upward variation in maintenance saying her ex-husband was in breach of an order issued in January.
Thelma Mashimbwe claimed $60 000 from her ex-husband, Tonderai Nyahodo.
She told the court that since she applied for the maintenance in January, Tonderai had not paid his children’s school fees.
“He is not paying our children’s fees. Despite the maintenance order, I am the one paying the fees,” she said.
Tonderai told the court that Thelma refused to transfer the children from a private school to a government school which accepts local currency.
“Thelma refused to transfer our child from a private school to a government school,” he said.
He also said he could only afford to pay $35 000 because he is a panner who makes US$50 per month.
Magistrate Sharon Mashavira ordered Tonderai to pay $50 000 as well as school fees.
He was also ordered to refund Thelma money she used to pay fees for their kids.
