Man(74) jailed for rape

Million Donado (74) pleaded not guilty to rape charges, but magistrate Ms Esthere Chivasa convicted him after a full trial. It turned out during trial that the girl was born HIV positive and had been on Anti-retroviral therapy since birth.
Donado was sentenced to nine years in prison before four years were set aside on condition that he does not commit a similar offence in the next five years. Ms Chivasa noted in passing sentence that Donado is old and frail, hence sending him to jail on a lengthy sentence was like sentencing him to death.
“Donado, who is 74, is now in the golden stage of life,” she said.
“As a senior citizen he should uphold societal values. Because of his insatiable sexual desires, he pounced on a minor who needs to be protected from such predators.”
Prosecutor Sarah Bosha told the court that on November 12 last year, the girl was sent by her brother to fetch water from Donado’s well within his premises.
Donado confronted the girl who was carrying a bucket of water.
He grabbed the girl by her hand and dragged her into his house where he tied her hands together with a piece of cloth, blindfolded her and gagged her mouth with pieces of cloth.
After subduing the girl, Donado forced her to the ground and raped her once. The minor’s brother who had seen her being dragged into the house followed.
Upon opening Donado’s door, the brother saw her hands and legs tied and her mouth gagged.
Donado offered the girl’s brother R5, pleading with him not to report the matter.
The brother told the court that he untied his sister, took her home and used the money to buy cellphone airtime before calling his mother and informing her of what had transpired.
The matter was reported to the police, leading to Donado’s arrest.
