Mr Donald Ndirowei has postponed sentencing in the case of Marondera businessman Francesco Marconati who was convicted of fraud last week.
Marconati was found guilty of two counts of fraud.

In his ruling, Mr Ndirowei said Marconati unprocedurally removed Ms Song from the company’s directorship after falsifying documents that she had resigned.

The State, represented by Mr Anesu Chirenji, proved that Marconati provided false information to the companies’ registrar.

With Ms Song removed as a company director and as a signatory of the company’s accounts, she was replaced by the accused’s son, Alessandaro Marconati.

The court heard that Marconati did not follow procedures in removing the complainant and there was no general or shareholders meeting to do so.

He also did not advise Ms Song of the development.

As a result, US$6,8 million was lost due to this.

Marconati was released into the custody of his lawyer.
