MLISWA’S ZIFA CHALLENGE TO BE HEARD TOMORROW

BULAWAYO High Court judge Ngoni Nduna has deferred Temba Mliswa’s ZIFA challenge to tomorrow.

Mliswa, Benjani Mwaruwari, Farai Jere, Gift Banda and prophet Walter Magaya were disqualified from taking part in the January 25 elections for a number of reasons.

The case could not proceed yesterday because the ZIFA lawyers were seized with a similar case at the High Court in Harare.

Mliswa was at the High Court in Bulawayo yesterday in the company of his lawyers Musindo Hungwe and Tatenda Madamombe.

Hungwe said the case could not proceed as scheduled because the ZIFA lawyers were engaged in another High Court challenge in Harare.

The lawyers were representing ZIFA in a case in which the association’s decision to disqualify Magaya from running for the ZIFA presidency is being challenged.

The case will be heard on Friday.

This means that the ZIFA lawyers will be in Bulawayo tomorrow and will then rush to Harare for the hearing of Magaya’s challenge.

“They only became aware of the set down this morning. We were ready to deal with the matter. The respondents’ lawyers were appearing in another matter in Harare.

“The court decided to defer the matter to a later date, the matter has been deferred to Thursday at 0830 hours,” said Hungwe.

Derek Kossam, who stood on behalf of ZIFA yesterday, said the case could not be heard because the association only received papers late on Friday afternoon at about 1530 hours.

He said ZIFA only got to know that the matter was set to be heard in the morning yesterday at about 9am.

Mliswa, who was disqualified from taking part in the January 25 elections, has taken ZIFA to court citing some irregularities with the process.
