Former MDC-T MP Timothy Mubhawu was yesterday warned by the court against assaulting his wife before his domestic violence case was withdrawn. Harare magistrate Mr Vakayi Chikwekwe expressed concern over the decision by Mubhawu’s wife, Molleen Elizabeth, to have the matter withdrawn before plea. “It is unfortunate that the court’s hands are tied. Resources are wasted bringing the accused to court only for the complainant to withdraw the matter,” said Mr Chikwekwe.
“Women are advocates of their own rights and it is sad that some fail to stand for their rights. It is also sad that a former legislator is the perpetrator of domestic violence. The court’s hands are tied and has no option but to withdraw the matter,” he said.
To Mubhawu, Mr Chikwekwe said: “If you go and assault your wife again, this case will be resuscitated because this withdrawal is not an acquittal.” Molleen told the court that her husband asked for forgiveness and she forgave him.
Mubhawu allegedly struck Molleen with a machete accusing her of having an extra-marital affair with Pastor Manson Munava Mpofu. She sustained injuries and was treated at Parirenyatwa Hospital.
Mubhawu (52) was facing physical abuse charges in contravention of the Domestic Violence Act. Prosecutor Ms Patience Chimusaru said on May 15 this year around 9pm Mubhawu had a dispute with his wife over alleged infidelity with the pastor.
He dragged his wife into the bedroom and struck her with a machete.Molleen was cut on her right palm while trying to block the blows. She reported the matter to the police leading to Mubhawu’s arrest.
