Nyamandlovu man (30) claims stepfather sent him to have sex with a 15-year old girl

A 30-year-old man from Nyamandlovu, Umguza District, will spend 15 years in jail for having sexual intercourse with a female juvenile aged 15 years without her consent, claiming he was given the right to do so by the step-father of the girl.

Davison Nkomo of Thape line appeared before Bulawayo regional magistrate, Mr Archie Wochiunga, facing a charge of rape and was found guilty and convicted.

In passing the sentence the magistrate highlighted the aggravating factors that the complainant is a minor and that the age difference is too much. He then slapped him with 15 years in prison.

Prosecuting, Mr Owen Mugari, told the court that on January 29 and at around 11AM the accused person went to the complainant’s place of residence and upon arrival found the complainant in the kitchen feeding her young brother.

The accused then grabbed the complainant and muffled her mouth using his hands.

Nkomo then told the complainant that he wanted to have sexual intercourse with her and forced her to lie on the ground facing upwards.

He forced himself on the girl, and had sexual intercourse with her once without her consent, the court heard.

“Nkomo was caught red-handed on top of the complainant by the complainant’s young brother. He was asked what he was doing and he told the brother that he was sent by their step-father to have sexual intercourse with her and to take her as his wife,” he said.

On January 30, the complainant was escorted to Zimbabwe Republic Police Nyamandlovu by her mother to report the matter leading to the arrest of the accused person.

The complainant was referred to Nyamandlovu District Hospital for medical examination.
