Refer case to Supreme Court: Mwonzora

Regional magistrate Ms Fadzai Mhtombeni remanded the matter to June 20 for ruling.
Mwonzora, who is also a lawyer and Copac co chair is being charged with theft of trust property.
Through his lawyer, Advocate Thabani Mpofu, Mwonzora argued that the delay in bringing his matter to court had prejudiced him.
The State, said Adv Mpofu, should have approached Mwonzora as early as possible.
He said selective prosecution encountered in the matter falls within what the High Court contemplated adding that it breaches the equality guarantee set out in Section 18 of the constitution. Prosecutor Mr Sidom Chinzete is opposing the application arguing that Mwonzora had not made any case that warranted the Supreme Court’s intervention. He said the lawyer should defend himself during trial.
It is the State’s case that in May 2006, Everson Dandazi advertised stand number 157 Meyrick Park Mabelreign through an Estate Agent, CB Richard Ellis selling it for Z$4 billion. On May 23, Stephen Matongo entered into an agreement of sale with Dandazi and paid a deposit of Z$2 billion.
It is alleged Matongo failed to pay the balance on time and Dandazi refused to accept it, arguing it had been eroded by inflation. After Matongo and Dandazi failed to agree Mwonzora is alleged to have instructed Dandazi to cancel the agreement of sale.
Dandazi, it is alleged, gave Mwonzora Z$3,5 billion to refund Matongo but the money was allegedly never remitted.
The State says Dandazi made several other payments to Mwonzora amounting to Z$5,45 billion which he misappropriated leading to his arrest.
