TWICE in a year, a Rusape woman has begged a community court to ‘rein’ in her husband, whom she accuses of neglecting and denying her conjugal rights.
Ivy Chiukira told Chief Makoni’s court last month that her husband, Cholomoni Wakina is depriving her of essential marital benefits, while concentrating on his new flame.
Wakina had dragged his neighbour, Peter Matibinu to the court for being too close to his wife whom he is having marital problems with.
Matibinu is a bachelor.
Early last year, Wakina dragged Chiukira’s parents to the same court intending to divorce Ivy, but he later changed his mind after a counselling session by Chief Makoni’s wife.
Chiukira also raised the issue of lack of intimacy as the main problem in their marriage. In the latest case, Wakina was accusing Matibinu of dating his wife behind his back.
Wakina told the court that his wife was now keeping some of her household property at Matibinu’s house.
He said Chiukira was bragging that Matibinu was playing the real “father’s role” in his absence.
Matibinu was Wakina’s go-between when he was courting Chiukira.
However, Wakina told the court that he was not comfortable with the level of friendship between the two, as his wife has unlimited access to Matibinu’s house and sometimes keeps keys to the bachelor’s house.
“I am having marital problems with my wife and I have since married a second wife whom I am currently staying with at a new place.
“Chiukira is staying at our home in Magamba with the children. Chiukira once filed a physical assault case against me and I was sentenced to perform community service. I struggled to provide for my family during that period.
“This caused serious problems again and while we were being counselled, Chiukira shocked me when she told her sister that Matibinu was playing very key roles expected of a father while I was failing. I later learnt that Matibinu and Chiukira had developed a very close relationship.
“I discovered that our fridge is now at Matibinu’s house. My wife is also having unlimited access to Matibinu’s house. I was shocked that she actually has keys to Matibinu’s house.
“I warned Matibinu to stay away from my wife, but he is turning a deaf ear to my advice. I want him to explain to this court the nature of his relationship with my wife,” said Wakina.
Matibinu told the court that he was surprised by Wakina’s actions as he has known Chiukira since childhood and was the two’s go-between when they were courting.
“I grew up with Chiukira in Vengere as neighbours. She is more of a sister to me. I facilitated their relationship as Wakina used me as a go-between.
“We are friends up to date. She told me that things were not well at her home and I gave her some foodstuffs and allowed her to bring her fridge to my house since she had no electricity at her home,” he said.
Chiukira poured out her heart out, telling the court that Wakina was now giving too much attention to his new wife, neglecting her, yet being jealous.
She said Wakina should stop depriving her of her conjugal rights.
“Peter (Matibinu) is my brother and Wakina should not be jealous of this young man. I cannot sleep with him. The real issue is that my husband now has a second wife and that is where all his energy is being sapped. He is denying me my conjugal rights.
“The court should tell him that I am a normal human being who also has feelings. He should stop bothering Matibinu and focus on me. Yes, Matibinu ‘assisted me’ because my husband was failing to do so,” she said.
The court dismissed the case saying Wakina had failed to prove an adultery case against Matibinu and advised him to man up and give his two wives due attention.
