Sikhala obstruction of justice case: Magistrate recuses self

HARARE regional magistrate, Ngoni Nduna, recused himself from hearing Job Sikhala’s bail application in the fresh charges of obstruction of justice, which the politician is facing.

Magistrate Nduna, in his ruling, said while Sikhala’s application had no merit at all, he was recusing himself to give the politician a chance to apply for bail without feeling the court will be biased and will treat him unfairly.

Magistrate Nduna added that activism has no place in the courts and applications of that nature shouldn’t be made in such a scandalous manner.

He accused Sikhala and his lawyers of legal mischief.

Sikhala is back in court today where he is expected to file a bail application before a different court.

Allegations are that between May 25 and June 16, Sikhala knowing that the Moreblessing Ali murder case was under investigation and a manhunt for the suspect Pius Jamba Mukandi was underway, addressed mourners in Nyatsime, Beatrice.

The address was uploaded online, including YouTube, and he claimed that Ali was allegedly murdered by Zanu PF supporters.

This was intended to mislead the police in their investigations.

The State alleges that as a result of Sikhala’s utterances, the police investigations could have suffered potential prejudice.

His actions, according to the State, could have derailed the natural wheels of justice by misleading police investigations.
