A soldier’s application for a downward variation in maintenance was dismissed at the Harare Civil Court yesterday.
The soldier, only identified as Dihana in court papers, had taken his ex-wife, Silveria Nyangani, to the court seeking a downward review from $45 000 to $15 000 for the upkeep of his two minor children.
However, magistrate Ayanda Dhlamini dismissed the order because Dihana was in maintenance arrears.
“I am a soldier and I get my salary on the 15th of every month, and we came to court on the 18th of January that is why l failed to pay maintenance that month.
“I am asking the court to vary down the amount from $45 000 plus US$45 to $15 000 plus US$15 because I have a bank loan. The other child who is disabled needs money for medical attention and I am also providing for that.”
But Silveria opposed the application.
“I do not agree since he is in arrears because he did not pay for January maintenance.
“He indicated he obtained a bank loan to pay fees, but he only paid school fees for one child and only bought school shoes instead of complete uniforms. When I came to court claiming US$290 maintenance, he offered only US$10 and the court ordered him to pay $45 000 plus US$45,” she said.
