HARARE regional magistrate Taurai Manuwere has granted $300 000 bail to one of suspected robbers who are linked to six counts of robberies.
Gawaza Definitely Anesu was charged with six counts of robbery, of which five of them were dropped, after the State noticed he was not linked to any of them.
He was left with only one case and was advised to approach the High court for bail.
Justice Never Katiyo referred the matter back to the lower courts for further administration after Gawaza’s lawyer said there was a misrepresentation of facts.
Gawaza’s lawyer, Moffart Makuvatsine, told the court that he was merely implicated in these robbery cases.
He said Gawaza was not around when all the crimes were committed.
Makuvatsine told the court Gawaza was in South Africa where he was working.
He said he was only linked to one of the cases because he was now back in Zimbabwe when the robbery was allegedly committed.
“It is unfortunate that his story had not found favour with the magistrate’s court then but, through investigations, the police have managed to establish that he did not take part in the counts that they exonerated him from.
“It is submitted that this is a significant change of circumstances which warrants the court to re-look into the suitability of the applicant (Gawaza) as suitable candidate for bail,” submitted Makuvatsine.
The State’s previous bail denial was based on cumulative effects of the six counts.
Gawaza was being charged together with 11 other suspected robbers.
He was being charged together with Loveridge Dziwasha, a serving cop, former ZRP member Panganai Munemo, Tsaurai Kupara, an ex-CIO member, former Air Force of Zimbabwe member, Zvidzai Mangwanda, Geselda Fadzai Katema, Tapiwa Mafadze, Shadreck Matenga, Stephen Chikota, Nicholas Murasira and Tafirenyika Mariga.
