State withdraw charges against Joubert Crushers director

TWO Mutare businesspeople who were last year arrested over allegations of contempt of court by breaching a High Court order when they were accused of storming a quarry mine in Mutare, were set free after the State withdrew the case against them before plea.
Mr Daniel Moyana and Mrs Selinah Moyana were arrested on allegations of forcing operations at Joubert Crushers and Transport Private Limited to stop in May 2025, prompting the company’s director, Mr Andries Hendrick Joubert, to report the case to the police.
Prosecutor, Mrs Sharon Mlambo, informed the court that the duo allegedly contravened Section 182(2) of the Criminal Codification and Reform Act (Chapter 9.23)-commonly referred to as contempt of court.
“The complainant is Andries Hendrick Joubert (74) and is director of Joubert Crushers and Transport Private Limited, Fern Valley, Mutare. On May 16, 2025, Daniel Moyana and Selinah Moyana attended Sheerluck Mine, in Fern Valley, Mutare, and halted the company’s operations, thereby contravening the court order HCMTC94/25 issued by the High Court Judge at Mutare on May 14, 2025. The accused persons acted unlawfully,” said Mrs Mlambo.
The case, however, did not go to trial as the State withdrew the charges against the duo.
However, the two have since written to The Manica Post, clarifying that they were not employed as security guards at the mine, but are directors.
They said they are the majority shareholders and directors of Joubert Crushers and Transport (Private) Limited.
“The article in question published the following false and injurious statements, among others: that Daniel Moyana and Selina Moyana are merely “security guards” which is characterisation that is entirely false, demeaning, and without any factual foundation whatsoever.
“That the two “stormed” and unlawfully disrupted operations at Joubert Crushers and Transport (Private) Limited’s quarry, a company of which they are the majority shareholders and directors and falsely portraying them as trespassers and criminals on their own company’s property.
“That the alleged contempt of the High Court order HCMTC94/25 pertained to Joubert Crushers and Transport’s quarry operations located at Subdivision D of Dora Farm, which is factually and geographically incorrect.
“That Mr Andries Hendrick Joubert is the legitimate director and controller of Joubert Crushers and Transport (Private) Limited, a claim that is demonstrably false,” read part of the duo’s correspondence.
