Mr Jeremiah Mutsindikwa, for the State, told Bulawayo provincial magistrate Mrs Vivian Ndlovu that the State was withdrawing the charge against Tongai Chivanga before plea after the complainant filed a withdrawal affidavit.
In her affidavit, Miss Nashly Karuru stated that she was withdrawing the charge against Chivanga because he had apologised to her and she had accepted the apology.
“I am no longer interested in pursuing the case,” she wrote in the withdrawal affidavit.
The State case was that City Cap (not City Cab) employed Chivanga (31), of Block 2/470 Mpopoma Flats as a driver.
On 23 December last year, at about 11.30pm, he was hired by the complainant, who was in the company of her friend, from the corner of Main Street and 6th Avenue.
They wanted to be dropped off at the corner of Robert Mugabe Way and Leopold Takawira Avenue.
When they got to the destination, the complainant’s friend got out of the taxi and gave Chivanga $2 but he refused to take the amount, arguing that the fare was $3.
He drove off from the scene with the complainant against her will heading for Lobengula West suburb and when they got to the Mpopoma
Zimpost, Chivanga told the complainant to drop off, the State had alleged.
She looked for alternative transport to the city centre and a report was made to the police leading to Chivanga’s arrest.
