Top businessman in court for fraud

TOP Harare businessman, Shongwe Michael Ndoro, yesterday appeared in court on fraud accusations.

Ndoro was not asked to plead when he appeared before Harare magistrate Tafadzwa Miti.

He was remanded to November 4 for possible provision of a trial date.

The first complainant is Precious Ndoro, a core trustee of Serial Dale Trust.

The second complainant is the Zimbabwe Energy Regulatory Authority (ZERA).

The court heard that sometime in 2018, Shongwe and Precious, who were still married, registered a company called Zororo Energy Company Limited.

Both parties are the current directors with 50 percent shares each.

The court heard that in 2019, the couple had a misunderstanding that led to Precious filing for divorce.

The High Court granted a divorce decree dissolving the civil union on November 26, 2019.

The High Court of Zimbabwe reserved the issue of appropriate distribution of matrimonial assets, that is immovable properties, which include Zororo Energy Company, for separate proceedings.

Soon after the divorce, Shongwe left the matrimonial home, taking with him title deeds of their joint properties and company documents.

It is the State’s case that Shongwe then forged a company resolution purporting that his ex-wife had resigned directorship and shareholding of Zororo Energy Company.

He allegedly went on to effect changes on the CR14 (directorship documents) by resigning Precious and appointing one Tunika Phaenah Mkhahanana.

He tendered the documents to ZERA, misrepresenting that the directorship had changed, and applied for an electricity generation licence.

Acting on the misrepresentation, ZERA made a public notice in a local newspaper in terms of section 4 (3) of the electricity (Licensing

Regulations).

On seeing the notice, Precious requested for all Zororo Energy Company Limited documents from Shongwe, who refused indicating that she was neither a director nor a shareholder in the company.

Precious then filed a police report.
