Tanyanyiwa is facing 52 counts of criminal abuse of office, eight counts of fraud and a count of corruptly concealing from a principal a personal interest in a transaction.
On the first fraud case, prosecutor Mr Oliver Marwa said Tanyanyiwa, well knowing that he had no money to buy a house, hatched a plan to defraud Chitungwiza Municipality.
He looked for a house to buy through an estate agent called Floburg Real Estate and settled for one in Chisipite, which was owned by Cloaktown Investments (Pvt) Ltd.
On September 22, 2010 Tanyanyiwa entered into an agreement of sale of the said property between himself and Cloaktown Investments (Pvt) Ltd, which was represented by Howard Baker at a cost of US$165 000.
Tanyanyiwa, the court heard, misrepresented to Kingdom Bank Graniteside Branch that Chitungwiza Mu-nicipality had authorised the transfer of US$80 000 from its account to Floburg Real Estate’s FBC account for the purpose of servicing Nyatsime stands.
Tanyanyiwa allegedly knew that the money was not for that purpose.
As a result, Chitungwiza Municipality was prejudiced of US$80 000, which he converted to his own use.
On the other fraud charges Tanyanyiwa allegedly instructed an employee from Floburg to collect various amounts totalling US$85 000 from Chitungwiza Municipality for the outstanding balance for the house he bought, the State says.
On charges of corruptly concealing a personal interest in a transaction from a principal, the State says during the period extending from September to December last year Tanyanyiwa allegedly offered his Chisipite house through his estate agent for rental to Chitungwiza Municipality director of urban planning, Mr Conrad Muchesa.
It is alleged Tanyanyiwa, with the intention to deceive, did not disclose his personal interest in this house to his principal (Chitungwiza Municipality) and council ended up paying him US$1 300 per month for five months as rental for his property.
As a result, council suffered a prejudice of US$6 500.
The town clerk is also accused of criminal abuse of duty after he alle-gedly corruptly acquired three commercial stands using names of three different shelf companies. He reportedly prejudiced his employer of US$170 000 when he allegedly dive-rted funds meant for the purchase of three Toyota Fortuners to buy his Toyota Land Cruiser V8 for US$170 000.
During the period extending from September to December last year on 50 different occasions, Tanyanyiwa is accused of corruptly authorising various cash payments amounting to U$337 253 to himself and other top council officials.
