TSHOLOTSHO Rural District Council is suing Zimbabwe Electricity Transmission and Distribution Company (ZETDC) for allegedly failing to settle a debt of more than $60,000 accumulated over a six-year period in unpaid land levies and service charges.According to the summons issued at the Bulawayo High Court, ZETDC was cited as the defendant while Tsholotsho RDC is the plaintiff in
the matter.
Summons filed by the council through lawyers Dube, Mguni and Dube Legal Practitioners read: “Plaintiff claims payment in the sum of $60,730 arising from service charges, land levies and way leave.
“Defendant through its pylons, power transmission lines and base stations is in occupation of land that falls under the administration and jurisdiction of the plaintiff.”
In the court papers, the council indicated that despite demanding the payment, the power utility has refused or failed or neglected to pay the amount.
Tsholotsho RDC is also claiming interest at a prescribed rate calculated from the date of service of summons to date of full payment and the cost of suit.
ZETDC has not yet entered an appearance to defend itself against the council’s summons.
