TWO men have been convicted of culpable homicide after they stabbed their brother-in-law.
The duo Samson Muhwati and Tichaona Petro are married to the late Aldrin Chinorwadza’s sisters.
The State said Chinorwadza accused both Muhwati and Petro of ill-treating his sisters and confronted them. Chinorwadza claimed the police had failed to act on the domestic violence charges his siblings had raised. The State said a misunderstanding, which then turned into a fist fight, ensued between Chinorwadza and the two men.
The deceased pulled out a knife but was overpowered before his own knife was used to stab him on the left side of his chest.
Chinorwadza later succumbed to the injuries leading to the charge of murder against Muhwati and Petro.
Muhwati and Petro pleaded not guilty to the murder but entered a limited plea of culpable homicide.
“All circumstances having been taken into account; the court was satisfied that the prosecutor’s acceptance of the accused’s plea to the lesser charge of culpable homicide was properly made,” read Justice Munamato Mutevedzi’s ruling.
