A 91-YEAR-OLD senior citizen has been granted a peace order against his son, whom he accused of abusing, assaulting and threatening him with eviction from his house.
The matter was heard at Mutare Civil Court, where magistrate, Ms Sarah Kanyenze granted the order in favour of Mr Morgious Jenya (91) after hearing allegations of repeated assaults, insults and intimidation by his son, Morgan Jenya.
Giving evidence before the court, the elderly man said his son had subjected him to persistent abuse, and had become increasingly hostile towards him.
“My son points an accusing finger at me, strangles me and even tries to force me out of my own house,” said Mr Jenya.
He said the situation deteriorated after his son experienced marital problems and returned to the family homestead.
“My son recently got into a dispute at his matrimonial home and said he no longer wants to stay with his wife. He wants to separate from her. Since then, I have had to endure his abuse, and I can no longer tolerate it,” he said.
The nonagenarian said he no longer wished to share a home with his son because of his alleged violent and disrespectful behaviour.
“I do not want to stay with him anymore because of the way he treats me. He should return to his wife and resolve his issues peacefully. He insults me and shows no respect for me as his father,” he said.
However, Morgan opposed the application, claiming he had been treated unfairly by some family members when he returned home.
“When I came back home, I expected a warm welcome, but instead I felt threatened. I had to flee to my room and lock myself inside,” he said.
He also accused his father of failing to support him during difficulties in his marriage.
“My father did not assist me with counselling when I was having marital problems with my wife,” said Morgan.
In her ruling, Ms Kanyenze said Morgan’s marital challenges and frustrations could not justify abusing, threatening or ill-treating his elderly father.
She granted a peace order protecting Mr Jenya, and directed Morgan not to harass, assault, threaten or attempt to force his father from the family homestead.
The court ordered that the peace order remain in effect for five years.
