Warning against stream bank cultivation

The agency said it will prosecute all those found carrying out agricultural activities in wetlands or near streams and rivers.
EMA public relations manager Mr Stead Kangata said they will also be prosecuting local authorities who allow random stream bank cultivation in their areas.

“Wetlands and streams are fragile and should not be used for farming unless a conservation plan is in place.
“Last year, people continued to practice stream bank and wetland cultivation despite our awareness campaigns. This year, we’ll descend heavily on all perpetrators of this practice to send a clear message that it’s illegal,” said Mr Kangata.

He said offenders would be charged under Section 20 of the Environmental Management (EIA and Ecosystems Protection) Regulations, Statutory Instrument 7 of 2007.
“This section states that it is an offence to operate or cultivate on land within 30 metres of naturally defined banks or highest flood level of a stream or wetland without a licence issued by the agency,” he said.

Cultivation is also prohibited on the verge of any spring, vlei, sponge, marsh, swamp, and reed bed. Mr Kangata said that continued stream bank and wetland cultivation would in the long-run result in the drying-up of rivers and dams.
