Wife claims $10 ooo damages

A ZIMUNYA woman is claiming $10 000 adultery damages from her husband’s girlfriend.

Theodora Chiparawasha of House Number 522, Zimunya appeared at the Mutare Civil Courts claiming damages from Rumbidzai Mabhiza.

She accused her of having an adulterous affair with her husband, Reuben Chiparawasha which started in 2011, despite her knowledge that they were legally married under the Civil Marriages Act, Chapter 5:11 in June 2006.

She gave a breakdown of her claim as follows: $3 000 for pain and suffering, $4 000 matrimonial property damage, $2 000 for the humiliation Mabhiza made her go through, $1 000 to compensate her two children who suffered at a tender age.

Theodora filed her first claim some years back, but was unable to pursue this case because of financial problems since she was staying at her parents’ house in Chitungwiza.

She told the court that she was called by Mabhiza in December 2012 to come back so that the two could live together under the same roof as Reuben’s wives.

Her husband also called her later in January 2013 asking her to come back and look after the children.

Upon arrival in January 2013, she found Mabhiza sitting at her house’s doorstep breastfeeding a newly born baby she had with her husband.

Upon realising that Mabhiza was still in love with her husband, Theodora claimed damages.

Mabhiza, however, denied the allegations saying that her relationship with Chiparawasha ended in May last year.

Judgment was expected to be handed down yesterday.
