Earlier Harare magistrate Mr Lazarus Murendo had sentenced the woman’s husband Joshua Moyana (23) to three years imprisonment of which one year was suspended on condition of good behaviour.
He was convicted for contravening Section 6 (i) of the Road Traffic Act Chapter 9:23.
The act criminalises driving without a licence.
In passing sentence Mr Murendo said the courts should not be lenient with unlicensed drivers and that the correct message should be sent to the public.
In aggravation prosecutor Mr Oscar Madhume had urged the court to pass a custodial sentence saying Moyana’s moral blameworthiness was high as he was risking human lives.
The agreed facts are that on November 21 this year at around 5pm Moyana was driving a commuter omnibus near Joina City in the city centre.
He was stopped by police who asked him for a driver’s license and he failed to produce one.
Investigations revealed that Moyana did not have a driver’s license and he was subsequently arrested.
Last week a Glen View 3 businessman collapsed at the same court while giving evidence in a court case in which his 20-year-old niece was raped.
The 62-year-old man who operated butcheries in Harare fell down and hit his head against the wall before finishing his testimony and was rushed to Parirenyatwa Hospital where he was pronounced dead on arrival.
The man collapsed as he was being cross-examined by the accused person, Jealous Taundi (22).
