The court considered that the elderly couple had a lengthy violent relationship and that Ms Zisengwe was trying to defend herself from the husband’s attack. It was the court’s finding that the woman had been a victim of domestic violence for a long time and that there was no proof of her intention to kill her husband. On August 15, 2010, the late Mr Peter Zisengwe arrived home around 9pm.
He was talking on the phone with his son when Mrs Zisengwe heard him blaming her for the fights and clashes the couple had.
Mrs Zisengwe confronted her husband saying she took the utterances as an insult and an altercation ensued.
At the height of the fight, Ms Zisengwe picked up a knife and stabbed her husband in the chest.
The couple’s son Ngaakudzwe disarmed his mother and hid the knife before rushing to call relatives in the neighbourhood.
Mr Zisengwe was rushed to Harare Hospital where he died on admission.
When the trial opened, Ms Zisengwe denied the murder charge claiming that she was acting in self-defence.
She denied having any intention to kill, adding that she was defending herself from an attack by her husband who was threatening to kill her.
