Woman gets community service for WhatsApp insult

BULAWAYO provincial magistrate Willard Maphios Moyo yesterday rebuked the woman who sent obscene messages to her lover’s wife saying her actions were undesirable and could have ended a marriage. The provincial magistrate chided Soneni Dube, 23, from Emganwini who sent insulting messages via WhatsApp to Janeth Matewa, 39.
In the messages, Dube bragged about her sexual exploits with Matewa’s husband.

“As for me, I actually like every bit of it, having sex in your house, in your bed, in your car, doing anal sex, using your bathing towel and after that you use it to bath your face. Ask why your face is rough,” read part of the message sent by Dube to Matewa.

The provincial magistrate sentenced Dube to six months in prison, two of which were suspended on condition that she does not commit a similar offence within five years.

The remaining four months were suspended on condition that she performs 210 hours of community service at Emganwini Secondary School.

In passing sentence, the provincial magistrate said Dube, who was charged for violating the Postal and Communications Act, deserved a more deterrent sentence.

“In your case the message was highly or grossly abusive and in that regard you deserve a maximum custodial punishment provided for by the Act. However, due to the fact that one of your children is one-year-old an imprisonment sentence will not be appropriate,” said magistrate Moyo.

The magistrate castigated Dube for violating the marriage institution by having an affair with a married man.
Moyo said Dube had predetermined intentions when she sent the messages. “You invaded the complainant’s marriage domain by having an affair with her husband. Those words were indeed calculated to hurt the complainant so much. Even in court you seemed not willing to apologise to her,” said Moyo.

The magistrate warned against the abuse of telecommunications facilities, saying the law will be used on anyone found guilty.
