THE State’s anti-graft case against Zimbabwe Anti Corruption Commission officer Smart Marlon Mandofa, who was arrested in 2023, collapsed yesterday — TWO years after he was first arrested.
Presiding magistrate Marewanazvo Gofa ruled that it wouldn’t be in the interest of justice to keep him on remand without any progress in the matter.
Mandofa applied for refusal of further remand and cried foul that it was now almost two years since his arrest but the State hasn’t made any progress in the matter
In her ruling magistrate Gofa said:
“The State has unreasonably delayed giving him a trial date. This is a case where the court must remove the accused person from remand because continuously remanding him will be prejudicial to the administration of justice,” she said.
Mandofa was accused of criminal abuse of office in that he allegedly turned a blind eye towards allegations against a businessman who was accused of fraud.
He was also accused of lying that an anonymous person had filed a report of forgery against Ofer Sivan at ZACC.
