A kiss of death for dating a married woman

A 35-year-old man from Rubatika Village, Seke was recently convicted and sentenced to 8 years effective after attempting to kill his wife’s 64-year-old boyfriend after he found them in a compromising position at their matrimonial home.

Chitungwiza Regional Magistrate, Gloria Takundwa had initially given Richard Mbiringa, a 10-year sentence before suspending two years on usual conditions.

He was facing attempted murder charges as defined in Section 47(1) as read with Section 189(1) of the Criminal Law Codification and Reform Chapter 9:23.

Ishmel Ditima is currently admitted at Chitungwiza Central Hospital where he is on life supporting.

He said Mbiringa bashed him thoroughly all over the body using a wooden stick, fists, metal bar, stones, bricks and he also lost his tooth in the process.

“I was with a girlfriend having quality time and I took a nap when the accused person arrived and gave me a thorough hiding and he later dragged me by my hand and dumped me close to his gate after he realised that I was now unconscious,” said Ditima.

No medical report had been compiled since there is still need for further medical examinations to ascertain the gravity of injury that was inflicted on him.

Public Prosecutor, Pamela Dzinduwa proved that on October 29 last year at around 7.30pm, Ditima entered into the accused’s bedroom and enjoyed the company of Abigail Ngwenya, who is the accused’s wife.

Mbiringa used to go home during weekends returned at around 8pm on the Tuesday and found the two lovebirds naked and lying on a mattress.

This did not go well with the accused who then attacked Ditima while his wife fled.

Ngwenya, who stood as witness, said she only heard some sounds from the beatings that were being inflicted to her boyfriend.

“I only heard some sounds of beatings, and I later came back after about 20 minutes to collect my child, who was crying, and to refrain my husband, who was giving the accused person a thorough hiding,” she said.

Mbiringa later dragged the complainant and dumped him by the gate and left him to die.

A ‘Good Samaritan’ who saw him lying unconscious about 15 metres from Mbiringa’s house reported the matter at Dema Police Station leading to the arrest.

Ditima was taken to Kunaka Hospital in Dema and later transferred to Chitungwiza Central Hospital.
