Court orders woman to be mentally examined

Harare magistrate Mr Dennis Mangosi has ruled that Elizabeth Parirenyatwa Mucheche who is facing allegations of threatening to kill businessman, Brian Murphy, who is a complainant in her perjury case, should be medically examined in terms of the Mental Health Act.

Mucheche is facing charges of perjury and threat to commit murder. Mr Mangosi ordered Zimbabwe Prison officers to make sure that Mucheche is examined before next Thursday before postponing the matter to November 15.

The ruling comes after the State on Wednesday submitted that Mucheche had claimed she was being driven by the spirit of Mbuya Nehanda to claim the estate of Brian James Rhodes which she alleged was stolen from her.

Prosecutor Mr Rufaro Chonzi applied for the matter to proceed in terms of the Mental Health Act after saying they suspected Mucheche to be suffering from a mental illness.

The defence opposed the application arguing that the State had to prove why she must undergo a mental health examination.

Allegations are that in October 2022 at 5 Woodbridge Close, Glen Lorne, Harare, Mucheche, who is not related to the late Brian James Rhodes or legally appointed as an executor of his estate, generated a fake power of attorney document.

On the second count of threatening to kill Brian Murphy, who is the complainant, the court heard that in July this year at the same address of 5 Woodbridge Close, Mucheche met Murphy and threatened to kill him after he had reported a case of perjury against her at ZRP Highlands.
