Gynaecologist up for culpable homicide

A MUTARE gynecologist and obstetrician, Dr Miriam Kanyenze, was on Monday arrested for allegedly causing the death of Miriam Makunura of Nyanga in April 2010. Manicaland provincial police spokesperson, Inspector Tavhiringwa Kakohwa, confirmed her arrest and said investigations were in progress.

He said Dr Kanyenze was being charged with culpable homicide as defined in Section 49 (a) of the Criminal Law (Codification and Reform) Act, Chapter 9:23.

The section reads: “Any person who causes the death of another person (a) negligently failing to realise that death may result from his or her conduct; or 40 (b) realising that death may result from his or her conduct and negligently failing to guard against that possibility; shall be guilty of culpable homicide and liable to imprisonment for life or any shorter period or a fine up to or exceeding level fourteen or both.”

The late Miriam Makunura’s husband, Mr James Manukura, said he would not leave no stone unturned until justice prevails.

In 2013, Dr Kanyenze appeared before the Medical and Dental Practitioners’ Council of Zimbabwe and was found guilty of improper conduct.

She was ordered to pay Mr Makunura $28 000 as compensation.

Failure to comply with the council orders left Mr Makunura with no option, but to approach Parliament for redress on May 29, 2014.

In an interview on Tuesday, Mr Makunura, said Dr Kanyenze was supposed to pay him $28 000 as compensation for all his expenses, for the medical bills, funeral and the bride price he had paid his in-laws, but the money now has interests amounting at about $40 000, making a total of $68 000 since she never paid anything.
