High Court dismisses bid to halt Bindura mining operations

THE High Court has struck off an urgent application seeking to stop mining activities at Botha Gold Mine in Bindura, ruling that the matter lacked urgency.

In a judgment delivered on March 26, 2026, Justice Kwenda dismissed the application by Ms Heather Anesu Mahureva under Case No.HCH1234/26, with costs.

Mahureva had applied for an interdict to halt operations, citing allegations of violence, environmental breaches and illegality. However, the court found that the grounds advanced did not justify urgent intervention.

Legal experts said the ruling underscores that allegations of violence fall within the remit of law enforcement and do not constitute sufficient basis to suspend mining operations through urgent court processes.

The decision leaves in place an earlier High Court spoliation order (Case No. HC 653/26) granted by Justice Mandaza, which restored possession of the mining area to Botha Gold Mine. The order remains valid and enforceable.

The dispute between Botha Gold Mine and Freda Rebecca Gold Mine is still before the courts, with key issues, including the status of Mining Lease 21, yet to be determined.

The latest ruling means mining operations will continue pending finalisation of the matter.
