A MUTARE woman last week successfully applied for a protection order against the wife of the husband she is cohabiting with. Mildred Nyamubika appeared before Mutare magistrate, Mrs Anniah Ndiraya, praying for protection against Theresa Muchinazvo who was disturbing her peace with the alleged husband she snatched. Nyamubika was accusing Muchinazvo of being violent whenever she came to her house looking for her husband.
The enraged Muchinazvo told the court that her husband was neglecting his family because of Nyamubika.
She said: “Your Worship, we were friends with Nyamubika and we used to be vendors. When I suspected that Nyamubika was having an affair with my husband I confronted her, but she lied to me that there was no relationship at all.
“As I speak, the five children I have with my husband are no longer going to school because he is no longer fending for them. My husband is now staying with Nyamubika and I will be looking for him.
“I am opposed to the order because I will not be able to see my husband again. Nyamubika wants to take my husband for good. She once reported me to the police after she fabricated a story against me. I will also apply for an order that will stop my husband from going to her house.”
However, Mrs Ndiraya advised her that there was no such application or order. She was advised to apply for maintenance.
Ms Ndiraya said: “Apply for maintenance to get money for the upkeep of the children. If your husband feels like he no longer wants to go to Nyamubika’s house, he will apply for the order himself. You cannot stop your husband from marrying another wife because you were not legally married to him, so you created the opportunity for him to marry another wife.”
She granted the order in favour of Nyamubika and ordered Muchinazvo not to interfere with her peace as that would warrant her arrest.
