Lawyer in $24k trust fund scam

Harare lawyer Osca Hute, of Hute and Partners Legal Practitioners, has been implicated in an alleged abuse of over $24 000 in trust funds after converting proceeds from the sale of a client’s property to his own use.

The Herald is in possession of a letter Mr Hute allegedly wrote to his client, Ms Mandy Nyama, confirming he would reimburse the $24 000 he converted to personal use after being entrusted with the money.

“I, the undersigned, Osca Hute, of Hute and Partners Legal Practitioners. . . do hereby admit and or acknowledge that I am liable and hold myself bound to Mandy Ndindase Nyama for the due and proper payment of $24 200 by reason of money previously held in trust.

“I agree to pay the principal debt of $24 200 plus interest calculated at the rate of five percent per month from June 1 2015 to the date of payment in full.

The full debt shall be paid in full by July 31 2015. At least $10 000 shall be paid on or before June 30, 2015 and the balance thereof within the next 30 days,” the letter reads.

Efforts to get comment from Hute were fruitless as his phones were not available for the past two days.

A visit to his work place bore no fruit either, as the front receptionist said he was last seen there last Friday.

Law Society of Zimbabwe president Ms Vimbai Nyemba confirmed that they had received the complaint.

“We received a complaint and the society is carrying out some investigations on the matter,” she said.

Last month another Harare lawyer, Fiona Machekeche, is reported to have abused over $42 000 a Mr Marlvin Mbazima had placed as proceeds of his property in her trust.

She was suspended from practice for up to six weeks while investigations were being carried out to clarify what happened to the funds.

Her law firm, Machekeche and Partners, was also placed under curatorship.
