Lawyer locked in land wrangle

A PROMINENT Bulawayo lawyer is locked in a protracted legal wrangle with a city businessman over the ownership of a piece of land at a farm in Insiza District. Advocate Sampson Samuel Mlaudzi has taken businessman Never Moyo to court accusing him of illegally tilling his land at Plot 11 Glencoe Farm.

Mlaudzi wants Moyo to immediately vacate the property, which he alleges to have acquired from the government under a 99 year lease agreement.

Mlaudzi, through his law firm, Samp Mlaudzi and Partners, filed summons at the Bulawayo High Court seeking the eviction of Moyo.

In the event that the order is granted in his favour, Mlaudzi wants Moyo to immediately vacate his property.

The lawyer also wants the court to direct the sheriff of the High Court to eject Moyo in the event that he resists eviction.

“The defendant used to mistakenly till my patch of land until 2013 when the government surveyed the plots at Glencoe Farm. After the survey, it was confirmed that the land that Moyo has been tilling actually belonged to me.

“I repossessed the land and have been in peaceful occupation until January 2016 when Moyo unlawfully started fencing around that piece of land,” argued Mlaudzi.

He said despite demand, the businessman has failed or refused to vacate the farm.

Moyo has not yet filed a notice to enter an appearance to defend the summons.
