Magistrate rejects US$1 796 maintenance claim as excessive

A HARARE woman’s claim for US$1 796 in monthly maintenance for her three children was rejected by a magistrate today after the amount was deemed excessive.

Rejoice Svikiro appeared before Harare magistrate Ms Makonye Janemary seeking a maintenance order against her former husband, Lovemore Chidanamabwe, for their 13-year-old child and seven-year-old twins.

Svikiro told the court that Chidanamabwe, who earns a living selling residential stands, had failed to contribute towards the children’s upkeep since the couple separated.

She said her monthly income of about US$150 from street vending was insufficient to meet the family’s basic needs without additional financial support.

Svikiro stated that she required US$756 for school fees, US$300 for school uniforms, US$200 for food, US$150 for casual clothing, US$110 for unforseen necessity, and US$50 for medical expenses.

Ms Janemary asked Svikiro to describe the family’s lifestyle before the dissolution of the marriage.

Svikiro explained that they previously enjoyed a comfortable lifestyle when she worked for a non-governmental organisation, but her contract subsequently ended when the employer closed operations.

The court heard that Chidanamabwe has no other children, with his current wife being his only dependent.

Magistrate Janemary ordered Chidanamabwe, who was not in the courtroom, to pay US$150 or its ZiG equivalent monthly for the three children, as well as 50 percent of each child’s school fees.

The maintenance order will take effect at the end of this month and will remain active until the children turn 18 or can support themselves.
