A 30-YEAR-OLD man from Nkulumane recently attacked his 15-year-old niece for helping herself to a saving of his rice.
Justice Moyo appeared before magistrate Shepherd Mjanja of Western Commonage courts facing charges of physical abuse as defined on section 4(I) as read with section 3(I) (a) of the domestic violence act chapter 5:6. He pleaded guilty.
Representing the state, Melisa Dube told the court that Moyo could not stomach that his niece helped herself with the rice and a misunderstanding ensued which resulted in him violently kicking his niece several times on the stomach.
So brutal was the assault that a medical examination report indicated that she sustained internal injuries which may cause stomach pains from time to time for the rest of her life.
For the offence Moyo was sentenced to 18 months imprisonment. Six months of the sentence was suspended for three years on condition that he does not during the period commit any similar offence and another 12 months was suspended on condition that he completes 420 hours of community service, at Sigombe Primary school in Nkulumane.
The community service was directed to start on 6 June 2022 and must be completed within 12 weeks of that date, between 8am and 4pm from Monday to Friday.
