A MAN has been convicted of culpable homicide for killing his brother during an altercation.
He was acquitted of the murder charge.
He was sentenced to 10 years imprisonment, with three years suspended on condition that he doesn’t commit a similar offence in the next five years.
Rangarirai Mafigu was convicted by High Court judge, Justice Lucy Mungwari.
The court heard that two brothers, Rangarirai and Chriswell Mafigu, stayed together at Range Farm, Centenary.
On November 14 last year, at around noon, a confrontation between the two brothers escalated into a physical fight.
Sensing his own vulnerability, Rangarirai resorted to throwing bricks at his brother, narrowly missing him on both occasions.
He threw a hoe which struck Chriswell on the left side of the head.
He fell and died instantly.
Rangarirai denied the murder charge and pleaded guilty to a lesser charge of culpable homicide.
Justice Mungwari was satisfied with the limited plea.
In mitigation, Rangarirai told the court that he was a first offender.
