Protection order against wife

A MUTARE man is living in fear and suffering a torrid time at the hands of his estranged wife and children who are allegedly physically and verbally abusing him.

Mark Tima, who seemingly and painfully lost the head of the house status last week, bared it all at the Mutare Civil Courts where he was applying for a protection order against his estranged wife, Veniah Magada.

He said his “violent” wife partners with his children to abuse him, further alleging that they were barring him from hiring tenants to occupy their matrimonial house.

Mark revealed that he had since moved out of the house in fear and was now staying in a wooden cabin.

Mutare magistrate Mrs Yeukai Chigodora granted a protection order in favour of the visibly distraught Mark.

“Your Worship, I am praying for a protection order against this woman. I am not sure if l can still call her my wife because I last slept with her ages ago. She has been abusing me physically, verbally and economically all these years.

“I have got scars that I can show the court as proof. I am deeply distressed because of her and my children’s uncouth behaviour. She has also been refusing to let me hire tenants to stay in other unoccupied rooms since I moved out. My children are now married and they no longer stay at the house. The other room Your Worship is always locked up and I have noticed that there are some baskets stored in that room. I am sure the baskets contain something harmful and I want legal assistance for me to remove the baskets from the room so that I can use it,” he said.

Verniah Magada who was represented by Mr Peter Makombe of Makombe and Associates argued that her husband had been previously barred from visiting the house by the courts because of his violent behaviour and had last had a misunderstanding with him in 2008.

“He is very violent and abusive. He is very irresponsible.”

She also claimed that she was still staying with their three children at the house.

The three children were cross-examined and they all confirmed that they were still staying with their mother.

However, Rudo claimed that she was divorced after her father had claimed 20 beasts from her ex-husband.

“I am struggling to make ends meet because I am over 60 and only survive through selling firewood, while this family in enjoying everything. We have a child who is in Canada and she sends money, but l don’t get anything. I wish you could visit my place of residence, it is a three-roomed wooden cabin which is not in good state. I am only asking for some rooms to lease out to tenants so that I can raise money for my up-keep,” lamented Mark.

Mrs Chigodora could not grant Mark his plea to evict his children saying: “It is up to you to evict the children since they are all majors.”
