South African national fined US$400 for killing a cyclist in an accident

A South African national has been sentenced to pay a fine of US$400 for hitting a cyclist who died on the spot due to the injuries sustained from the accident.

Mmantlebeka Ernest Modi ba of Polokwane South Africa, appeared before Western Commonage magistrate Mr Jeconia Prince Ncube facing a charge of culpable homicide.

He pleaded guilty to the charge and was initially sentenced to pay a fine of US$400. In default he will be sentenced to 12 months in prison.
The fine is payable before March 3, 2026. The accused was further banned from driving in Zimbabwe for 24 months.

Prosecutor, Ms Cathrine Kuzu, told the court that on February 5 this year, at around 4.15 PM, the accused drove a motor vehicle a Man Afrifit Truck registration number LJX873MP towing two trailers registration number MF35CLGP and MF35HVGP along Mpopoma drive due south.

The court heard that when the accused person was turning into Khami Road due west near Woodlot Timbers PVT LTD, Kelvin, he hit a cyclist Hebert Nyasha Matukutuku who was traveling along Khami Road due east.

The cyclist died on at the spot due to injuries sustained in the accident, said Ms Kuzu.
The accused’s motor vehicle was inspected at the VED Bulawayo Depot, heard the court.
