Woman demands upkeep

A Mutare vendor has approached the civil courts seeking maintenance from her ex-husband whom she alleges to have intentionally infecting her with HIV/Aids. Mavis Nyakatawa appeared before Mrs Yeukai Chigodora claiming the money to cover for her medical expenses as well as take care of their six-months-old baby. She said her ex-husband, Taurai Madondo, who is a soldier, is capable of paying $100 as maintenance.

Nyakatawa said Madondo deserted her and moved on to live with other women. “He earns $400 Your Worship, therefore I need only $100 for the upkeep of our six months old baby. The burden is too much on my own. I am a vendor and at present it is difficult for me to go and sell because I need to take care of the baby,” she said.

In response, Madondo offered $40 for the upkeep of his child only but this infuriated Nyakatawa who went on to tell the court that Madondo had infected her with the deadly virus. She thus claimed her medical maintenance cover.

“I can only pay $40 as maintenance because I am currently paying another $60 maintenance order for an 11 year old child. I earn $400 per month and I am a married man therefore if I give her the amount she demands my family will suffer,” said Madondo.

Nyakatawa rubbished his response saying he should be a responsible father. “Your Worship, this man is in the habit of harassing me. At times he chased me away and brought his prostitutes home. After all he infected me with the deadly virus. I need him to pay for my medical bills,” said Nyakatawa.

The presiding magistrate ordered Madondo to pay $40 as maintenance and advised Nyakatawa to file a different application if she needs him to pay for her medical bills. “Madam this is a different application I urge you to sue him if you are really sure that he is the reason behind your infection. The law will take its course and not at this moment,” said Mrs Chigodora.
