In an urgent chamber application filed at the High Court, ZETDC is seeking the court to order Winfair Investments to pay the outstanding bill or alternatively have its property seized to recover the money.
ZETDC represented by Muza and Nyapadi Legal Practitioners in its declaration submitted that the company has a contractual obligation to pay for power supplied to them on a monthly basis.
But, ZETDC averred the company was in breach of the agreement in that they have not been paying for their electricity.
“In terms of the parties contract the defendant (Winfair Investments) is entitled to pay the plaintiff (ZETDC) 10 percent collection commission in the event of suing for recovery of debt,” ZETDC submitted.
ZETDC further submitted that despite lawful demand the company has refused to pay the US$10 000.
Winfair Investments is yet to respond to the lawsuit set to be heard by Justice Ben Hlatshwayo.
Meanwhile, ZETDC has already taken legal action against two Harare schools over outstanding bills.
The schools are – Highfield High School Number 2 and Highfield Community School and each owe the power utility US$2 146,57 and US$4 465,82 respectively.
