Lawyers seek PM’s arrest

LAWYERS representing Ms Locardia Karimatsenga intend to meet Attorney-General Mr Johannes Tomana as a follow up to a letter they wrote last week seeking Prime Minister Morgan Tsvangirai’s arrest.

This comes in the wake of statements by Ms Karimatsenga that she is not yet done with the PM until he owns up to their marriage.
Mr Jonathan Samukange of Venturas and Samukange said Mr Tsvangirai lied under oath in denying ever marrying Ms Karimatsenga.

Section 183 of the Criminal Law (Codification and Reform Act) criminalises perjury.
The lawyer also said there was an element of fraud in the case emanating from the said misrepresentation.

“He (PM Tsvangirai) made an affidavit in which he lied that he only paid damages.
“The same affidavit was used by the judge to dismiss our application.

“We spent three days going to the court striving to convince the court of the existence of a customary marriage when he knew he had paid lobola.”
PM Tsvangirai, Mr Samukange said, also misled the court when he initially appeared before magistrate Mr Munamato Mutevedzi seeking a marriage licence.

PM Tsvangirai married Ms Karimatsenga in November last year.
Ms Karimatsenga was later introduced to the Tsvangirai family in Buhera where she spent two months at the PM’s homestead. End of last year, PM Tsvangirai issued a Press statement dismissing the marriage, saying it had been hijacked by security agents.

Ms Karimatsenga later suffered a miscarriage, after which Mr Tsvangirai snubbed her.
The PM in April this year engaged Ms Elizabeth Macheka whom he customarily married, and was officially handed over to him last Saturday.
Speaking through her lawyer Mr Samukange yesterday, Ms Karimatsenga said she was comfortable to be in a polygamous marriage.

Tsvangirai to contest marriage licence’s cancellation

LAWYERS representing Prime Minister Morgan Tsvangirai and his wife Ms Elizabeth Macheka say their clients intend to seek review of last Friday’s cancellation of a marriage licence by a Harare magistrate.

Mr Innocent Chagonda of Artherstone and Cook law firm said his clients would also appeal against the decision by High Court judge Justice Chinembiri Bhunu in dismissing an urgent chamber application to suspend the lower court’s ruling.

Mr Chagonda is instructing Advocate Thabani Mpofu in the matters.
Harare provincial magistrate Mr Munamato Mutevedzi on August 27 issued a marriage licence to PM Tsvangirai and Ms Macheka.

But last Friday, the same magistrate revoked the licence after Ms Locardia Karimatsenga convinced him that she was already in a customary marriage with the PM.
Justice Bhunu at 2am on Saturday threw out an urgent chamber application to suspend the magistrate’s decision and to allow the wedding to proceed.

Mr Chagonda said he was working on the appeal papers.
“We are going to appeal against the High Court decision in the Supreme Court. At the same time we are preparing paperwork to take the magistrate on review at the High Court,” said Mr Chagonda.

The lawyer did not give details of the appeal and review application.
“Without getting into the details, we believe the judge (Justice Bhunu) erred for not setting aside the decision of the magistrate.

“We feel it is important for the Supreme Court to clarify the law on this very important aspect.”
Mr Chagonda said the applications would be filed soon.

Census payments doubtful, says finance ministry

THE payment of full allowances for 2012 census enumerators is now in doubt as Government is concentrating on raising salaries for civil servants.
Finance Ministry principal director Mr Pfungwa Kunaka said Treasury was trying to strike a balance between raising money for salaries and paying the enumerators.

He described the delay in paying enumerators as a “cash-flow management issue”.
“We also have salaries to pay and this means we have to strike a balance between paying the salaries and paying their allowances. We are looking for the money to pay them.”

Mr Kunaka however, said the enumerators were likely to be paid “something” this month.
“We gave them the first payment through the US$8 million we released to Zimstats and we will make another payment this month once we strike the balance.”

Government released US$8 million soon after the 10-day exercise, with the enumerators being paid US$150 each. They were reportedly promised US$500 each.

About US$10 million is needed to pay the 31 000 enumerators and 10 450 supervisors.
The enumerators have since raised complaints over delays in the payments. They claim that they used their own money for transport and other expenses thinking Government would pay them on time.
Most enumerators were drawn from the education sector.
