Chitungwiza Municipality was on Thursday ordered to deliver to Redan Petroleum 1,6 million litres of diesel that he borrowed four years ago.
Using the prevailing price of US$1,30 per litre, Mr Muzvidzwa is supposed to alternatively pay back US$2 million to the petroleum company.
Mr Muzvidzwa was among those entrusted with running the affairs of Chitungwiza Municipality pending investigation into alleged mismanagement and misappropriation of funds at the council.
In October 2008 Mr Muzvidzwa approached Redan Petroleum and borrowed the diesel promising to repay within six months.
He undertook to offer as security Number 28 Blair Road Ballantyne Park, title deeds for his flat in South Africa (Number 9 Monte Serino, Johannesburg) and shares in a company called Auxiliary Services Private Limited.
However, Mr Muzvidzwa failed to deliver the diesel and transferring properties tendered as security into Redan’s name was a challenge.
That prompted Redan’s lawyer Mr Godfrey Mamvura of Scanlen and Holderness to issue summons claiming the fuel back.
Mr Nigel Joseph Earl, who was a director at Redan, told the court during the trial that he was friends with Mr Muzvidzwa.
He said he had delivered the fuel to Muzvidzwa in trust.
During the court proceedings, Mr Muzvidzwa filed a counter-claim for US$159 000 against Redan.
Justice Mtshiya dismissed Mr Muzvidzwa’s counterclaim and ordered him to deliver the fuel or to pay the equivalent in cash.
“The defendant’s (Mr Muzvidzwa’s) claim is hereby dismissed.
“The defendant is hereby ordered to deliver 1 600 000 litres of diesel to the plaintiff or alternatively pay the plaintiff a sum in United States dollars sufficient to purchase the said 1 600 000 litres of diesel in Zimbabwe . . .” ruled Justice Mtshiya.
