JAILED former City of Harare acting finance manager Stanely Ndemera and the city valuer and estates manager Emmanuel Mutambirwa have been convicted of illegally parcelling out commercial stands on land leased to Old Hararians Sports Club.
Ndemera is serving a six-year jail term on another case.
The duo appeared before High Court Judge, Justice Benjamin Chikowero, charged with criminal abuse of office.
The State led by Mr Whisper Mabhaudi and Mr Loveit Masuku said between September 2018 and August 2020, the suspects acted in cahoots to facilitate the sale of the stands.
The stands were sold to sister companies Optel Enterprises, Silver Harbour Enterprises and Leanforth Investment.
Ndemera and Mutambirwa failed to follow the provisions of Section 152(2) of the Urban Councils Act [Chapter 29:15], which requires them to give notice of the council’s intention to sell land.
They are expected back in court this week for sentencing.
Former Harare Mayor Hebert Gomba and the city’s valuation technician Daniel Usingarahwe were acquitted of the charges.
